This Acceptable Use Policy is in addition to our General Terms and Conditions which you must read and agree to before opening an account.

IN REGISTERING FOR AN ACCOUNT OR ORDERING ANY SERVICE, YOU AGREE TO ABIDE BY THIS POLICY.

  1. Service Use

    1. We reserve the right to suspend or cancel access to any or all services, for any customer where we decide that the account has been used inappropriately.
    2. We reserve the right to suspend or terminate any service which is used to host, transmit or disclose material that is slanderous to us or our associated companies or partners.
    3. Site content must not contain any material that does not comply with our content guidelines as provided in section 3.
    4. Some services or packages may offer an amount (or unlimited amounts) of web/disk space or bandwidth. This space/bandwidth may be used solely for legitimate content only. All files stored within this space must be part of the website and actively provided for visitors to the site.
    5. Some services or packages may offer a number of mailboxes, FTP accounts, databases, or other resources. These mailboxes, FTP accounts, databases, or other resources are intended for legitimate use by the account holder only. You may not resell or offer these items to any third party. Where you create or use such resources which we deem are not for a legitimate use by the account holder, we reserve the right to restrict, suspend or cancel the service or your account.
    6. We reserve the right to delete mailboxes, including the content of that mailbox, where the mailbox has not been accessed within the last 180 days. Mail Lite accounts will be deleted after 60 days if not accessed or if otherwise deemed to be inactive.
    7. We reserve the right to remove any dormant databases or websites, including all content, at any time.
    8. You may not resell or offer any of our services to any third party, unless specifically authorised by us to do so as part of a reseller account.
  2. Acceptable use guidelines

    1. You may not use our services for any purpose as follows:
      1. in any way that is fraudulent, aids or gives rise to fraud;
      2. in a way that breaches any applicable regulation or law (UK and/or International);
      3. to host, store, or transmit any material that is not in line with our content guidelines as stated in section 3;
      4. to transmit any unsolicited or unauthorised advertising, promotional, or marketing material - also known as SPAM or Unsolicited Commercial Email (UCE);
      5. to publish or distribute any illegal content, including but not limited to copyrighted software, videos, music, or other pirated material. It is up to you to prove that you own the rights to any material published and that you are authorised to distribute such material;
      6. for file backups or storage. All files uploaded to your website space must be visible and available to visitors of the site unless they are hidden files for the purpose of operating that site. We reserve the right to delete files which we deem violate this clause, without providing notice to you;
      7. to participate in any file-sharing or peer-to-peer activity;
      8. to host or provide access to an Internet Relay Chat (IRC) server; or a bot that is part of, or connected to, an IRC network or server;
      9. to host, or provide access to, an Email Server; or provide Email services;
      10. to use an excessive amount of server resources, including but not limited to processor utilisation, bandwidth, and/or disk space;
      11. to offer downloads from any website where the files are not directly related to the subject matter of the site. We reserve the right to archive or delete any files that are, at our discretion, not needed for the normal operation of the site;
      12. to provide a proxy service, anonymous or otherwise;
      13. to redirect visitors from a non-adult website to an adult website, including but not limited to a .XXX website.
    2. You may not attempt to change, bypass or otherwise manipulate any timeout, security setting or other restriction that may be applied to our systems. Any attempt to do so will result in immediate suspension or termination of your service and/or account.
  3. Content guidelines

    1. These guidelines apply to all services offered by us, including all web and email services.
    2. Any material published, transmitted or otherwise distributed through any service we provide, must:
      1. be accurate (where stating facts);
      2. comply with all applicable law in accordance with paragraph 2.1.2.
    3. Your material or content must not:
      1. be defamatory of any person or organisation;
      2. be obscene, malicious, blasphemous, profane, offensive or inflammatory;
      3. be threatening, abusive or invade another person’s privacy, or cause annoyance, inconvenience or unnecessary anxiety;
      4. contain any adult material with the exception of content hosted on .XXX domains. ‘Adult material’ includes all pornography, lewd, or otherwise obscene material, as designated at our sole discretion;
      5. contain (whether on a .XXX domain or not) any photograph, film, video, picture, or computer or computer-generated image or picture, whether made or produced by electronic, mechanical, or other means, depicting child pornography as defined in the United Nations Convention on the rights of the child.
      6. infringe any copyright or trade mark or other intellectual property rights;
      7. contain a virus or other hostile programming;
      8. be likely to deceive any person;
      9. promote or assist in any illegal activity;
      10. be used to misrepresent your identity or affiliation with any person or organisation.
    4. Content or material hosted on a .XXX domain must at all times comply with all IFFOR policies which can be found at https://iffor.org/policy/baseline-policies/
  4. Enforcement

    1. We will, solely at our discretion, determine if there has been a breach of this policy through your use of our Services and may take action as we deem appropriate in accordance with paragraph 1.1.
    2. Any failure to adhere to this policy will be treated as a breach of our Terms and Conditions and may result in any of the following actions:
      1. temporary or permanent archiving or removal of any content in breach of our Content Guidelines as laid out in section 3;
      2. immediate withdrawal of any or all services on either a temporary or permanent basis;
      3. issue you with a warning allowing you to correct the breach;
      4. issue legal proceedings against you for reimbursement of any and all costs on an indemnity basis – including, but not limited to, reasonable administration and/or legal costs;
      5. other legal action against you; or,
      6. disclosure of the material to law enforcement authorities
    3. The responses we may take in paragraph 4.2 are not the limit of what steps we may take, and we may take other actions as deemed appropriate.
    4. You agree that you will not hold us liable in any way for any costs, loss of income, loss of reputation, or other form of liability, for any response we take as a result of any breach of this policy.

    1. We will always be happy to discuss any aspect of the services we offer and to answer any questions you may have. We will always treat those discussions in the strictest confidence.
