These terms and conditions apply to our Domain Services and are applicable to all domains registered on, or transferred to, your account.

They enhance and supersede our General Terms and Conditions.  Any clause in these terms shall take precedence over a conflicting or competing clause in our General Terms and Conditions.

BY USING ANY REGISTERED DOMAIN, YOU ACCEPT THESE TERMS and any amendments that may we be required to make in the future.

  1. Definitions

    1. “Registrant”
      means you or the person registering any domain.
    2. “Registry/Registries”
      means the company or organisation that maintains a list of all registered domain names. The Registry used is dependent upon the extension of the domain.
    3. “Registrar”
      means the company or organisation that manages domain name reservations. The Registrar works with the Registries and acts on behalf of the Registrant.
    4. “ICANN” (Internet Corporation for Assigned Names and Numbers)
      is a non-profit organisation which oversees all domain Registrars and Registries. All Registries and Registrars, including us, are required to comply with ICANN policies which are constantly evolving. For further information refer to the ICANN website.
  2. Domain registration and transfer

    1. In registering or transferring a domain to us, you authorise us to act on your behalf in all matters relating to the registration, use and management of that domain. Authorisation shall last until the domain expires, you cancel the domain, or you transfer the domain to another agent.
    2. On receipt of your domain registration request, we shall pass your registration information to the domain registry responsible for that domain extension, who shall then put the registration into effect.
    3. It is your responsibility to ensure that any registration, transfer, or renewal has been processed successfully. You can check the status of your domain using WHOIS.
    4. It is your responsibility to ensure that the contact details for the domain registration are always accurate and valid. We may, at our discretion, refuse to renew any domain where we believe the contact information is not accurate.
    5. When registering a domain, ICANN policies ensure that each Registrant is given certain rights while at the same time placing certain responsibilities on the Registrant. Full details can be found at https://www.icann.org/registrants
    6. Following the transfer of a domain to another agent, we shall have no responsibility for maintaining a domain registration and shall not be required or responsible for performing any actions in relation to that domain, including, but not limited to registration renewals, or the provision of any associated DNS records.
    7. Some domain extensions carry with them restrictions on who can register domains names:
      1. Where appropriate, we may request evidence that you are able to meet those restrictions, for example we may require proof of address, utility bills, photo ID, or proof of professional membership.
      2. We may reject any registration request which does not comply with the restrictions or where the Registrant chooses not to provide us with the required evidence.
      3. Any restricted registration which is accepted without evidence or where the evidence is later found to be invalid or fake, may be cancelled without refund. It is the Registrants responsibility to ensure they meet the requirements for registration of the chosen domain name.
      4. We will keep any provided evidence safe and secure in our records purely for the purpose of proving your eligibility for the domain and may provide such evidence to the Domain Registry in the event of an audit request. We will not divulge or use your information for any other purpose.
      5. Any documents provided to us will be deleted or destroyed from our records upon the domain expiry or termination of the domain.
  3. Ownership and transfers of ownership

    1. The person, company or organisation named as the Domain Registrant during the ordering process shall be the “Registered Domain Owner” and the contact details provided must be accurate.
    2. The contact information provided will be validated against publicly available information such as, but not limited to, Companies House or Electoral Role information.
      1. Validation may take place at any time as part of random checks but will also occur as part of the registration or renewal process, and when changes are made to the domain.
      2. Invalid contact information will result in domain suspension and/or cancellation. It is the Registrants responsibility to make sure the contact details are constantly up to date.
    3. The account owner, or anyone with access to the account, is deemed to be authorised to act on behalf of the Registered Domain Owner.
    4. When transferring ownership to another party (the “Transferee”), the Registrants shall require the Transferee to agree and abide by our General Terms and Conditions, these Domain Service Terms, and the terms and conditions of the relevant Domain Registry.
    5. For domains not ending with .uk:
      1. When making changes to the first name, last name, company name, and/or email address, a 60 day transfer lock shall be applied to the domain registration.
      2. When transferring ownership, the Registrant explicitly authorises ourselves and Tucows to act as their Designated Agent, as stipulated by the ICANN Transfer Policy, and which allows them and us to authorise the transfer on your behalf.
  4. Third party registrations

    1. Where registering a domain on behalf of a 3rd party, you represent that you are authorised to act on behalf of the 3rd party and that you have their express, written, consent to disclose their personal information to us.
    2. Where you are registering a domain for a 3rd party, you represent that you have the authority to bind that entity to our Terms and Conditions.
    3. You must register the domain in the name of the 3rd party and not your own name. You may only register a domain in your name if you have the express written permission of the 3rd party.
  5. Domain names

    1. To the best of your knowledge, you represent that the domain name and any usage of the domain name does not and will not infringe on any legal rights, including trademarks, of any 3rd party; and that the domain name will not be used for any illegal purpose.
  6. Your privacy and personal data

    1. You authorise us to pass your contact details to ICANN, the Domain Registry, or any other 3rd party as we are required to do so either by ICANN or by law enforcement, and as allowed and permitted by law.
    2. You can review, modify or update your personal information at any time using our online control panel.
    3. Any information provided by you will only processed in ways that are explicitly allowed by these terms.
    4. We will store your information securely and take all reasonable precautions to protect your data from loss, misuse, unauthorised access, disclosure, alteration or destruction.
  7. Fees

    1. The fee for Domain Services is based on the extension of the domain name as laid out in our Pricing Schedule. Fees may be amended anytime and without notice.
    2. All fees are payable in advance of any registration, transfer or renewal and must be received in full before we action your registration/renewal/transfer. At our discretion, if we perform the action before receiving full payment, we reserve the right to cancel the registration or restrict use of the domain until full payment is received.
    3. Fee’s are non-refundable, in whole or in part, even where a domain name is suspended, cancelled or transferred prior to the end of the registration term.
    4. Unless you tell us otherwise, we will attempt to automatically renew your domain at the end of the registration period.
      1. 30 days before expiry, we shall attempt to renew your domain registration for the same term as the initial registration.
      2. Renewals are charged at the rate applicable at the time of the renewal and may vary from the initial registration term.
      3. Renewals are non-refundable. It is your responsibility to ensure you disable auto-renewal ahead of time if you no longer require the domain name. You can do this using our Online Control Panel.
    5. In the event of a chargeback by a credit card company or payment provider, as the paying entity, the domain name shall be transferred to us and become our property. We may re-instate your registration at our discretion and following the payment of all outstanding amounts along with an administration charge of £75.
  8. Free domain registration

    1. Where a service or package includes a free domain registration, the free registration applies to the initial period only and not to the renewal of the domain.
    2. Free domains offered with a service or package are subject to the terms and conditions specified in Offers and Promotions
  9. Free email (Lite Mail)

    1. Use of a free email account is governed by our Email and Exchange Terms of Service.
    2. Our free email offer is subject to the terms and conditions as specified in Offers and Promotions.
  10. Disputes over ownership

    1. You agree to be bound by the Domain Disputes Policy, including any future amendments, which is incorporated and made part of these Domain Service Terms.
  11. Limitations of liability

    1. You agree that we shall, under no circumstances, be liable for any special, indirect, incidental, punitive, exemplary or consequential damages as a result of:
      1. suspension or loss of your domain;
      2. use of your domain name registration;
      3. access, delays or interruptions to any websites, email, or other services assigned to your domain name;
      4. processing of a domain registration, transfer or renewal;
      5. non-delivery, mis-delivery, corruption, destruction or modification of data;
      6. interruption to your business;
      7. events beyond our reasonable control;
      8. application of the Domain Disputes Policy.
    2. We shall not, under any circumstances, be liable or responsible, for any errors, omissions, or other actions by the Domain Registry, arising from or related to:
      1. your registration application, receipt of, or failure to receive a domain registration;
      2. any renewal or transfer request, or failure to complete such a request;
    3. Our maximum aggregate liability shall not exceed the greater of:
      1. the total amount paid by you for the domain registration; or
      2. the sum of £50.00 (UK Pounds).
  12. Indemnification

    1. You agree to indemnify and hold us and the domain registry harmless, from and against any claim, action, suit, demand, loss, damage, costs (including reasonable legal fees, expert witness fees and expenses), or other proceedings related to or arising from the use of the domain name.
    2. In the event of a domain dispute, you agree to indemnify and hold us harmless pursuant to the terms and conditions contained in the Domain Disputes Policy.
  13. Suspension or termination

    1. We reserve the right to suspend, cancel, transfer, or modify your domain registration if:
      1. you materially breach these terms;
      2. you use the domain name to send unsolicited commercial email;
      3. you use the domain name for an illegal purpose or to support any unlawful activity;
      4. grounds arise as provided by these terms;
      5. you use the domain name for any purpose which is slanderous to us or our associated companies or partners;
      6. you provide inaccurate information;
      7. you fail to update or maintain accurate information;
      8. you fail to respond to our enquires concerning the accuracy of contact information within fourteen (14) calendar days.
    2. You agree that your domain registration may be suspended, cancelled or transferred by ICANN or the Domain Registry or another Registrar, in accordance with ICANN procedures.
    3. You agree that we may suspend, cancel or transfer any domain registration where we are requested to do so as a result of an order from a court or otherwise competent jurisdiction, or as a result of an arbitration award.
